Following the collapse of the communist states it was assumed that Marxist philosophy had collapsed with it. In _Introduction to Non-Marxism_, François Laruelle aims to recover Marxism along with its failure by asking the question “What is to be done with Marxism itself?” To answer, Laruelle resists the temptation to make Marxism more palatable after the death of metaphysics by transforming Marxism into a mere social science or by simply embracing with evangelical fervor the idea of communism. Instead Laruelle proposes (...) a heretical science of Marxism that will investigate Marxism in both its failure and power so as to fashion new theoretical tools. In the course of engaging with the material of Marxism, Laruelle takes on the philosophy of Marx along with important philosophers who have extended that philosophy including Althusser, Balibar, Negri as well as the attempt at a phenomenological Marxism found in the work of Michel Henry. Through this engagement Laruelle develops with great precision the history and function of his concept of determination-in-the-last-instance. In the midst of the assumed failure of Marxism and the defections and resentment that followed, Laruelle’s non-Marxism responds with the bold declaration: “Do not give up on theory!”. (shrink)

Merleau-Ponty’s writings on the philosophy of painting, though widely influential and much discussed, remain enigmatic. In this paper I compare his views on painting with those of his older contemporary, Jacques Maritain, who also holds that painting can give us a non-conceptual insight into deep truths about things that are inaccessible to discursive thought. I argue that some ideas that are obscure and undeveloped in Merleau-Ponty are developed more clearly and fully in Maritain. Even where there are significant differences between (...) them, these are not as great as it might at first seem. This comparison can help us to see the ways in which both philosophers’ theories of art are important for understanding their philosophies as a whole. Furthermore, the views they hold in common can continue to suggest a plausible and fruitful way to think about art today. (shrink)

In this essay, an attempt is made to re-present African Communitarianism as a discursive formation between the individual and community. It is a view which eschews the dominant position of many Africanist scholars on the primacy of the community over the individual in the ‘individual-community' debate in contemporary Africanist discourse. The relationship between the individual and community is dialogical for the identity of the individual and the community is dependent on this constitutive formation. The individual is not prior to the (...) community and neither is the community prior to the individual. Contemporaneity explains this dialogic relationship and to argue otherwise threatens the individual's subjectivity to a vanishing point, or simply, to deny the individual a presence. On this trajectory, the politics of common good within the African value system can neither be described nor represented through consensus or unanimity but through a realist perspectivism or a worldview not held in abstraction from living traditions, cultures, and values that characterize the people of sub-Saharan Africa. _I am. We are. That is enough. Now we have to start._ These are the opening words of Ernst Bloch's first major work, _The Spirit of Utopia,_ written mostly in 1915-16, published in its first version just after the First World War, republished five years later, 1923, in the version here presented for the first time in English translation. _The Spirit of Utopia_ is one of the great historic books from the beginning of the century, but it is not an (...) obsolete one. In its style of thinking, a peculiar amalgam of biblical, Marxist, and Expressionist turns, in its analytical skills deeply informed by Simmel, taking its information from both Hegel and Schopenhauer for the groundwork of its metaphysics of music but consistently interpreting the cultural legacy in the light of a certain Marxism, Bloch's _Spirit of Utopia_ is a unique attempt to rethink the history of Western civilizations as a process of revolutionary disruptions and to reread the artworks, religions, and philosophies of this tradition as incentives to continue disrupting. The alliance between messianism and Marxism, which was proclaimed in this book for the first time with epic breadth, has met with more critique than acclaim. The expressive and baroque diction of the book was considered as offensive as its stubborn disregard for the limits of "disciplines." Yet there is hardly a "discipline" that didn't adopt, however unknowingly, some of Bloch's insights, and his provocative associations often proved more productive than the statistical account of social shifts. The first part of this philosophical meditation—which is also a narrative, an analysis, a rhapsody, and a manifesto—concerns a mode of "self-encounter" that presents itself in the history of music from Mozart through Mahler as an encounter with the problem of a community to come. This "we-problem" is worked out by Bloch in terms of a philosophy of the history of music. The "self-encounter," however, has to be conceived as "self-invention," as the active, affirmative fight for freedom and social justice, under the sign of Marx. Among the distinguished intellectuals of sixteenth-century Italy was Antonio Brucioli, renowned for participating in the gatherings in the garden of the Rucellai in Florence during the second decade of the sixteenth century. Since Delio Cantimori’s fundamental article and Giorgio Spini’s fundamental monograph, Brucioli’s Dialogi have been valued for the insight they afford into the discussions of the Rucellai group. Twice in the Dialogi Brucioli offers a revealing discussion of music. The references reflect intellectual traditions of great significance and longevity and (...) afford valuable insight into the late-Renaissance reception of such venerable doctrines. (shrink)

In early 1927, Pascual Jordan published his version of what came to be known as the Dirac-Jordan statistical transformation theory. Later that year and partly in response to Jordan, John von Neumann published the modern Hilbert space formalism of quantum mechanics. Central to both formalisms are expressions for conditional probabilities of finding some value for one quantity given the value of another. Beyond that Jordan and von Neumann had very different views about the appropriate formulation of problems in the new (...) theory. For Jordan, unable to let go of the analogy to classical mechanics, the solution of such problems required the identification of sets of canonically conjugate variables, i.e., p’s and q’s. Jordan ran into serious difficulties when he tried to extend his approach from quantities with fully continuous spectra to those with wholly or partly discrete spectra. For von Neumann, not constrained by the analogy to classical physics and aware of the daunting mathematical difficulties facing the approach of Jordan ), the solution of a problem in the new quantum mechanics required only the identification of a maximal set of commuting operators with simultaneous eigenstates. He had no need for p’s and q’s. Related to their disagreement about the appropriate general formalism for the new theory, Jordan and von Neumann stated the characteristic new rules for probabilities in quantum mechanics somewhat differently. Jordan was the first to state those rules in full generality, von Neumann rephrased them and then sought to derive them from more basic considerations. In this paper we reconstruct the central arguments of these 1927 papers by Jordan and von Neumann and of a paper on Jordan’s approach by Hilbert, von Neumann, and Nordheim. We highlight those elements in these papers that bring out the gradual loosening of the ties between the new quantum formalism and classical mechanics. (shrink)

A personal view made in light of the recent news article regarding a husband wanting to sue Addenbrooke's hospital over a Do Not Attempt Resuscitation decision. This article aims to highlight how the rolling out of cross boundary palliative care registers may be more at risk of infringing human rights.

Although there are several provisions within the Nigerian legal framework that, however, address the issue of church attack, the state capacity to implement effective constitutional sanctioning on perpetrators of this heinous crime has always been found wanting or completely absent, leading to countless religious attacks on churches with seeming state consent. This study employs semi-structured interviews to draw data from affected families from Benue and Enugu States, Nigeria. The article explored their experiences. The study participants were recruited through snowball sampling (...) technique, and data were analysed thematically. The respondents stated that church killings or killing of Christians is rising because of the fact that perpetrators stand lower risk of detection and apprehension than other crimes. Also respondents interrogated that justification for the crime is land acquisition and religious intolerance. On the persistence of the challenge, all the 13 respondents stated that the crime seems to have state approval that has made it seemly impossible to tackle. The article calls for continuous inter-religious dialogue and intentional governmental responsibility in protecting lives of all persons living within the geographical enclave of Nigeria which is necessary for the common good. Closer understanding of other faiths and religions will help build bridges of peace and tolerance. The article also calls for the need to promote African traditional values, such as the value of sacredness of life, human respect and good neighbourliness. Contribution: This study initiated the discussions that will help the public understand the reason for continuous church attacks in Nigeria, what church crime connotes in the Nigerian context and its uniqueness from other crimes. These discussions sit quite well within the transdisciplinary religious perspective of this journal. (shrink)

Stanley Cavell has suggested that the deepest roots of skepticism lie in a sense of alienation between the subject and the world, and this has led him to reassess the philosophical importance of the Romantic project of “re-enchanting” the world. One way to pursue this project is by starting from Kant’s reflections on the sublime. I consider Julian Young’s recent discussion of this topic and the Heideggeran pantheism to which it leads him. I conclude that, while there is much insight (...) in Young’s reflections, there are crucial weaknesses in his position that point towards the plausibility of re-configuring it in more theistic and / or Platonic terms. This paper argues that the dominant discourse on cosmopolitanism has largely focused on its constitutive character while ignoring its substantive essence. While recognizing the contribution made by other intellectual traditions, the paper argues that none of the approaches have yet answered basic questions of how to live with the stranger beyond the requirement of the law. The paper is also critical of those versions of cosmopolitanism that privileges subjective preference to members of our community over the stranger, or that advocates (...) eradication of boundaries as key condition for cosmopolitanism. The paper champions subjective equality through dialogue as a key condition for cosmopolitanism. Subjective equality on the other hand defines our terms of global justice. (shrink)

Since its inception in the Middle Ages, the university classroom can be characterized by students gathered around a sage who imparts his or her knowledge. However, the effective classroom of today looks vastly different: First-year engineering students not only learn basic engineering principles, but are also guided to consider their own inner values and motivations as they design and build adaptive devices for people with disabilities; students in a large chemistry lecture work animatedly together in small groups on inquiry-based activities (...) while an instructor and teaching assistants circulate and guide their learning; students learning differential equations practice explicit metacognitive skills while problem-solving in class. Even though educational research, especially research that is targeted at STEM disciplines, demonstrates what most effectively engages students and supports their learning, many of today's classrooms look much like they did a century ago, with a professor delivering a primarily one-way lecture and students passively sitting in seats bolted to the floor. At this juncture in history, colleges and universities face a public call to engage a more diverse representation of students in effective learning, persistence, and degree attainment, and to do so economically and efficiently. It is essential that institutions draw upon methods demonstrated to effectively increase student learning and success. Educational researchers have thoroughly explored the "basic" science in this area, and a body of literature documents effective evidence-based instructional practices, hereafter referred to as EBIPs. In Harris v Digital Pulse Pty Ltd (2003) 56 NSWLR 298, the New South Wales Court of Appeal held that exemplary (or punitive) damages are not available for breach of fiduciary duty or other equitable obligation. The decision runs counter to authorities in Canada, New Zealand and some U.S. states. Punitive (exemplary) damages is a hotly debated topic in the United States and it has attracted considerable interest among law and economics scholars, particularly in the tort litigation context. This article (...) analyzes the Digital Pulse case from a law and economics perspective. Polinsky and Shavell (among others) argue that the function of punitive damages is to achieve optimal deterrence in cases where the probability that the plaintiff will discover and successfully litigate the defendant’s wrongdoing is less than 1. Given the high costs of monitoring fiduciary behaviour, it might be tempting to conclude that exemplary damages should be routinely awarded for breach of fiduciary obligation. The article explains why this view is wrong. On the other hand, given the availability of gains-based remedies (the account of profits and the like) for breach of fiduciary obligation, it might be tempting to conclude that exemplary damages are never justified in fiduciary cases. The article explains why this view is wrong too. The main conclusions are that: (1) exemplary damages should be available for breach of fiduciary duty and the like, but not as a matter of course; and (2) exemplary damages were probably not warranted in Digital Pulse itself.
